AMENDMENT TO DEVELOPMENT APPLICATION DA2011/1208 – AMENDMENT TO TAVERN WITHIN THE ASHBY NEIGHBOURHOOD CENTRE – 6 HOLLOSY WAY ASHBY
The City has received an application for Approval to Commence Development for the above proposal. A tavern was approved on 14 March 2012 as part of the development application DA2011/1208 for the Ashby Neighbourhood Centre.
Detail of the proposed amendment to the tavern is as follows:
1) Increase the floorspace of the tavern from the currently approved 713.6m2 to 870.8m2.
The proposed amendment to the tavern will not alter the manner in which the currently approved tavern is intended to operate, which is as follows:
1) Operating hours are outlined below:
• Monday and Tuesday 10.00am to 10.00pm
• Wednesday and Thursday 10.00am to 11.00pm
• Friday and Saturday 10.00am to 12.00am
• Sunday 10.00am to 10.00pm
2) Anticipated peak operating hours will be from 6.00pm to 9.00pm, principally on Friday and Saturday evenings. Weekdays, particularly Mondays and Tuesdays, would be the quietest operating times;
3) The Tavern is expected to accommodate a maximum of 180 patrons at any one time, with the peak likely to occur on Friday and Saturday Nights. Approximately 100 patrons are anticipated to visit the tavern during weekday nights. It is expected that approximately 50 patrons will visit the Tavern during lunch times, and during the day. It is anticipated that Monday and Tuesday will be the quietest days for the Tavern;
4) Service vehicles will generally attend the site outside of shopping centre and Tavern peak operating times.

PROPOSED EXCISION & PURCHASE OF A 945M2 PORTION OF CROWN RESERVE 45553, HIDDEN VALLEY RETREAT, CLARKSON TO FACILTATE A CONTRACT OF SALE TO WESTERN POWER CORPORATION
The City of Wanneroo invites public comments on a proposal to excise a 945m2 portion of Class “C” Reserve 45553 for sale to Western Power Corporation (WPC) by way of private treaty as per Council resolution CB06-11/12 of 13 November 2012 and in accordance with Section 3.58(3) of the Local Government Act 1995, Section 86 of the Land Administration Act 1997 and Section 152 of the Planning and Development Act 2005, Department of Regional Development & Lands Guidelines.
Property Description:
A 945m2 portion of Crown Reserve 45553, 10 Hidden Valley Retreat, Clarkson, Lot 501 on Deposited Plan 57658 under Certificate of Title Volume LR3148 Folio 307.
Details of the Proposed Disposition:
It is proposed that the 945m2 portion of Crown Reserve 45553 will accommodate some of the necessary works to supply the Public Transport Authority's (PTA) northern rail extension. The PTA requires a supply to a proposed new traction substation at Nowergup rail yard, located 800 metres north of the WPC's Clarkson substation. The Nowergup traction substation will be constructed as part of the PTA's $240 million Butler Extension Project which will extend the Joondalup Line to Butler. The project was passed by State Parliament under the Railway (Butler to Brighton) Act 2010.
The City proposes to purchase the 945m2 portion of Lot 501, Reserve 45553 at 5% unimproved market value and sell to the WPC at full market value. The land has been valued at $154,000 (including GST) by the Valuer General and the City is required to pay $7,700 (including GST) to purchase the 945m2 portion of land for disposal to the WPC under a Contract of Sale at full market value. Proceeds of the sale will be expended within the local area to upgrade existing facilities and parks.Plan "2012-10 substation" depicts the 945m2 portion of Lot 501 that is proposed to be excised and sold to the WPC and is available below.
